What’s the Difference between
FMLA/STD and FMLA/WC?

โœ… FMLA (Family and Medical Leave Act) โ€“ Applies to Both

FMLA provides job-protected, unpaid leave (up to 12 weeks) for qualified medical or family reasons, such as:

  • Your own serious health condition

  • Caring for a family member

  • Birth/adoption of a child

It does not provide pay, but it does protect your job and health insurance.


๐Ÿฉบ FMLA + STD (Short-Term Disability)

This combination usually means:

  • You’re not injured at work, but you have a medical condition (e.g., surgery, pregnancy, illness)

  • You take FMLA for job protection

  • You receive income replacement through your employerโ€™s private Short-Term Disability insurance (usually 40โ€“70% of your income)

Key Points:

  • STD is a private insurance benefit

  • Therapist documentation often goes to a 3rd-party STD provider

  • You are paid while off work, if approved


โš–๏ธ FMLA + Workmanโ€™s Compensation

This means:

  • You were injured on the job

  • FMLA still protects your job and health benefits

  • But income and treatment are covered by Workmanโ€™s Comp insurance, which is regulated by state law

Key Points:

  • You must go through Workmanโ€™s Comp procedures

  • Treatment providers must agree to the terms of the Workmanโ€™s Comp carrier, see note* below.

  • Therapists must be contracted with Workmanโ€™s Comp to provide services, see note* below.


๐Ÿšซ Why This Matters for Therapy:

  • Many private therapy practices, including Embrace, * do not participate in Workmanโ€™s Compensation programs due to administrative and reimbursement structures that do not align with our clinical and billing standards.

  • However, they can provide services for STD/FMLA clients if documentation supports the claim.



FMLA & Short-Term Disability

At Embrace, our FMLA & Short-Term Disability services are tailored to your need.

    • Call your HR department and inquire about your employee FMLA & Short-termed Disability benefits.
    • Call or Text Embraceโ€™s Intake Specialist at 972.292.7092 EN/ES.
    • Intake Specialist will accept a copy of your FMLA forms as well as your Short-Term Disability certification form and all ROIs at YouMatter@EmbraceNewLife.com or fax 972.292.7092.
    • FMLA forms require a minimum of 2 sessions to initiate (intake). FMLA is recertified every two weeks and requires weekly sessions with your ENL therapist. FMLA will not be certified after 1 visit. FMLA certification requires weekly sessions until ready for Return-to-Work certification. This is a standard requirement.
    • Short-term Disability forms require a minimum of 2 sessions to initiate (intake). Short-term Disability is recertified every two weeks and requires weekly sessions with your ENL therapist. Short-term Disability will not be certified for more than 2 weeks at a time to report progress to your insurance company.
    • Good faith-estimate: FMLA & Short-Term Disability Intake โ€“ $300 for 2 session intake, $300 for each additional sets of 2 weeks requested leave (or $150 per week on leave).
    • Letter verifying Return-to-Work will only be provided at completion of last session.
